The circular requests that the orderly exploitation of rare earth resources be ensured and the dynamic supervision of key resource sites and mines be strengthened, and that illegal and illegal mining sites (including recovery and utilization) such as mining for prospecting, undocumented mining, cross-border mining and illegal outsourcing be banned and closed in accordance with the law, illegal income confiscated, and ground facilities be thoroughly cleaned up. Strictly control and control the recovery of crushed rare earth resources, and carry out a comprehensive clean-up of the recovery projects of crushed rare earth resources in this region.
The notification requires strict implementation of the mining and smelting separation plan. Imports of rare earth minerals from major rare earth groups shall be included in the management of the mining plan. Processing of imported minerals shall be included in the management of the smelting separation plan. Combined with the annual total amount control plan for rare earth mining and smelting separation, the traceability system for rare earth products, the amount of special invoices for rare earth value added tax, and the certificate of resource tax payment, the implementation of the plan is regularly checked and the substitute processing business is strictly prohibited. Enterprises that violate laws and regulations by purchasing, processing and reselling illicit rare earth mineral products, producing in excess of schedule, and using multiple import formalities and certificates shall be dealt with seriously according to law.
The circular calls for standardization of secondary resource recovery enterprises, comprehensive investigation of existing secondary resource recovery enterprises in the jurisdiction area, restriction on such enterprises to use rare earth functional materials and device waste as raw materials, and prohibition of using rare earth ores (including imported rare earth ores), concentrates and rare earth compounds as raw materials. Strictly control the number and scale of newly added rare earth secondary resources recovery and utilization (including monazite treatment) enterprises, and strictly prohibit disguised approval of smelting separation enterprises under the name of secondary resources recovery and utilization.
The circular also calls for strengthening the supervision of product circulation, and for enterprises with mining plans to issue special invoices for rare earth value-added tax when selling rare earth mineral products (including imported rare earth ores) and when smelting and separating enterprises sell rare earth smelting and separating products. If there is no rare earth mining plan, it shall not engage in the management of rare earth mineral products (including imported rare earth minerals). Supervise enterprises such as rare earth mineral products, metallurgical separation products and rare earth metals to faithfully issue special invoices for rare earth value-added tax, and may not counterfeit their names. To inspect the rare earth trading enterprises from time to time, verify the source and quantity of the products traded, and to deal with the enterprises that buy and sell illegal rare earth products and do not open or falsely open special invoices for rare earth value-added tax according to law and regulations.
